HIPAA Notice of Privacy Practices

This notice describes how medical information about you may be used and disclosed and how you can get access to this information. Please review it carefully.

Weightstry’s affiliated medical practice is committed to protecting the privacy of your protected health information as required under the Health Insurance Portability and Accountability Act of 1996 (HIPAA). Who This Notice Covers

This Notice of Privacy Practices is issued by Weightstry’s affiliated medical practice (the “Practice”) — the physician-led professional entity, directed by our Medical Director, whose licensed clinicians provide your care. The Practice is a HIPAA-covered entity.

Weightstry, LLC provides the technology platform and administrative services that support the Practice and handles protected health information (“PHI”) on the Practice’s behalf as its business associate, under a Business Associate Agreement. This notice applies to PHI created or received by the Practice and its clinicians, workforce, and business associates.

How We Use and Disclose Your Health Information — Treatment

We use and disclose your PHI to provide, coordinate, and manage your care. This includes your treating clinician and care team reviewing your intake and history, ordering labs, prescribing and adjusting medication, and sharing information with the pharmacies and laboratories involved in your treatment.

Payment

We use and disclose your PHI as needed to obtain payment for the services you receive — for example, to process your membership and service charges and to coordinate medication and lab billing with the pharmacies and laboratories that supply them.

Health Care Operations

We use and disclose your PHI for the Practice’s operations — including quality assessment and improvement, clinician review, training, and the general administration needed to run the Practice and improve the care we provide.

Business Associates

We share PHI with business associates — such as our technology and electronic health record providers, and Weightstry, LLC — who perform services on the Practice’s behalf. Each business associate is required by a written agreement to safeguard your PHI and to use it only for the purposes we permit.

Other Uses Permitted or Required by Law

We may use or disclose your PHI without your authorization where the law permits or requires it, including to:

  • Send appointment reminders and treatment-related communications
  • Comply with federal, state, or local law and respond to lawful requests
  • Support public health and safety activities, such as reporting required by law
  • Address health oversight, judicial, or law-enforcement requirements as authorized by law

Uses That Require Your Written Authorization

Most uses and disclosures not described in this notice will be made only with your written authorization. In particular, we will obtain your authorization before any:

  • Marketing use of your PHI
  • Sale of your PHI
  • Use or disclosure of psychotherapy notes, if any

You may revoke an authorization in writing at any time, except to the extent we have already relied on it. We do not sell your PHI or use it for advertising.

Your Health Information Rights

You have the right to:

  • Inspect and obtain a copy of your PHI
  • Request a correction or amendment to your PHI
  • Request an accounting of certain disclosures we have made
  • Request restrictions on certain uses and disclosures
  • Request that we communicate with you by a specific means or at a specific location
  • Receive a paper or electronic copy of this notice on request
  • Be notified if a breach of your unsecured PHI occurs

Our Responsibilities

We are required by law to:

  • Maintain the privacy and security of your PHI
  • Provide you with this notice of our legal duties and privacy practices
  • Abide by the terms of the notice currently in effect
  • Notify you if a breach of your unsecured PHI occurs

Changes to This Notice

We may change this notice and make the new terms effective for all PHI we maintain. The effective date above reflects the most recent revision, and the current notice is always available on this page.

Complaints

If you believe your privacy rights have been violated, you may file a complaint with us at patientcare@weightstry.com, and you may file a complaint with the U.S. Department of Health and Human Services, Office for Civil Rights, at hhs.gov/hipaa/filing-a-complaint. You will not be retaliated against for filing a complaint.
